BIOSECURE Act readiness and supply-chain public affairs

BIOSECURE readiness support for Chinese life-sciences companies facing U.S. customer, supply-chain, or federal procurement questions. We organize ownership and vendor facts, contract exposure, policy developments, and counsel-reviewed communications. Enacted law, implementation requirements, customer policy, and individual contract terms are checked separately; qualified counsel determines legal applicability.

Reviewed: 2026-11-03

Current policy status

As of November 3, 2026, BIOSECURE provisions are enacted in section 851 of the FY2026 NDAA, Public Law 119-60. The 2024 H.R. 8333 proposal is historical context, not the current enacted text. Counsel must check designations, implementation steps, effective dates, exceptions, and the actual customer contract before concluding that a restriction applies.

Decision-ready outputs

Exposure and contract matrix

Identify the contracting entity, customer type, federal funding or procurement nexus, equipment and services, subcontractors, affiliates, data flows, and questionnaire language. Record the actual provision and version behind each request, separating law from a customer’s internal standard.

Supply-chain evidence pack

Index ownership, vendors, facilities, laboratories, data access, and potential alternatives. Mark unverified vendor assertions as open questions. Similar names or commercial associations do not establish a designation or restriction.

Customer and policy materials

Prepare a counsel-reviewed factual note, executive Q&A, business-continuity record, and stakeholder map. A policy comment and a customer response have different audiences; neither is a legal exemption or a guarantee that an order will be preserved.

First 72 hours

0–24 hours

Confirm the entity, business objective, deadline, actual request, and current counsel. Agree a safe channel before sharing sensitive records.

24–48 hours

Verify the official provision, identity, operative-versus-proposed status, and supporting facts. Mark legal, technical, or scientific questions for the appropriate specialist.

48–72 hours

Prepare the issue matrix, evidence index, first stakeholder Q&A, and an approval-gated plan. This is a preparation milestone, not an agency response or decision deadline.

Questions before engagement

Is BIOSECURE still only a proposal?

Relevant provisions are enacted in Public Law 119-60. Implementation, designations, timing, and contract-specific requirements still need review. The old H.R. 8333 text is not a sufficient current-law reference.

Can you preserve a federal order or NIH-related relationship?

No outcome is guaranteed. Agencies and customers apply their own lawful procedures. We organize the factual record, open issues, and communications supporting the client and counsel.

What information starts the review?

A non-sensitive business summary, customer request, contracting entity, supply-chain outline, deadline, and current U.S. advisers. Do not send patient data or detailed proprietary technology in an initial inquiry.

Do you provide legal advice?

No. Qualified counsel assesses legal obligations; the appropriate specialists validate technical and data-security conclusions.

Official sources

Start with a short mandate summary

Describe your entity, objective, deadline, and current advisers. Do not include patient data, export-controlled material, or detailed trade secrets in an initial inquiry.
